So in reality if you are 17 and your girlfriend or boyfriend is 16 and you have sex...it is statutory rape. Only a girl can be raped, if a girl 17 or over has sex with a guy under 17 it's considered sexual misconduct or sodomy. Very rare to see anyone convicted of this if the age years aren't too far apart, but its techincally the law. The age varies from state to state but I can tell you in NY its definitely 17. orphans answered Saturday December 24 2005, 10:16 pm: well in the united states the age of consent is 18, but that varies from state to state. in texas for example it's 17, whereas in connecticut it's 16. but the fact is most court cases dealing with this situation they are tried under the federal standard of the age of 18 thus making sex with someone under that age against the law. i'm 19, my girlfriend is 17, if we have sex and she decides to take the issue to court (or her parents decide to) then i will go to jail for statutory rape simply because she was under 18. and my record will be essentially ruined because of something so simple. and i would be a registered sex offender for something that didn't really hurt anyone but me. the justice system is quite flawed on these grounds but reform is a hard thing to do [ orphans's advice column | Ask orphans A Question ]
