what the heck...

Question Posted Wednesday April 13 2005, 4:52 pm

im asking this question for my friend...

one year ago, when my friend and her family were away, some little girl was walking through the alleyway. my friend's neighbor's dog is really big and scary, so the little girl ran, and jumped my friend's fence to hide from the dog, and as a result, broke her arm and needed surgery.

one year later, my friend's parents get a letter in the mail saying that they will be getting sued because it happened on their property. IT'S NOT EVEN THEIR FAULT. can they fight against this?

the little girl thourght the dog was scarry. you cant controlwhat anyone else thinks, thats imposible-and everyone who isnt living under a rock, knows that. also, if the dog was on a leash, then you are fine. its the girls fault really, because she got scared, of an inniocent dog, and ran over a fence, and broke her arm. and maybe she should have been drinking more milk because maybe thats why her arm broke (but that isnt a great point, its sounds sarcastic, but i am sarcastic lots) anyways, the dog didnt do anything, so they didnt do anything wrong. and thats just stupid. it isnt even worth the $ of getting sued, the parents of the little girl are just stupid I guess.

but i agree that it isnt their fault. if you need anything else, please leave one in my inbox, because i am sure that was sort of confusing!

also, it was the girls fault for being on their property, dur!!! so, its the girls fault, she shouldnt have been there in the first place.
and she should have known that climbing over the fence was a bad idea in the first place!!

thanks for letting me help you!

As long as there is a fire there's a fight. Sounds to me like it was no one's fault. The dog scared the girl, the dog was being a dog, the girl jumped the fence because she was scared, and it happened on your friends property. Tell your friend that maybe they should just talk with the parents of that little girl, no one should be sued for this, Best of luck

jokerzgrl answered Thursday April 14 2005, 5:05 pm:
Yeah, it wasn't their dog. The parents are just looking for someone to sue. The girl can sue the owner of the dog but not the parents, and if she does sue the parents, there is a slim chance she would win, but in today's society, you never know.

Yeah they can because if they have proof no one was at their house that they were outta town there is no way they would have ANYTHING to do with it so therefore they could not get blamed in any way!

selectopaque answered Wednesday April 13 2005, 10:54 pm:
If your friends neighbors did not have a "Beware of dog" sign on their property, clearly visible, than they are the one's who should be sued.

Here's why:
If you go onto someone's property and are not warned that they have a dog, and then get hurt by that dog, then it is their property owner's fault. Running away from the dog and falling constitutes being hurt by the dog.

Therefore, when the girl ran from the dog, on your friend's neighbors property, and stupidly broke her arm, it is legally the poor dog's fault.

If your friend's neighbors had clearly marked "Beware of Dog" signs on their property at good intervals away from each other, then it's the girls fault and she can't sue anyone.

IfIonlyhadaLIFE answered Wednesday April 13 2005, 5:30 pm:
Well yes they can. It's very likly the court will just drop the suit because like you said it wasn't their fault. And why was that girl walking down the ally ALONE. It wasn't their dog, and even though it was their property I don't see why they waited a year before the lawsuit.

If you have anymore questions just drop one in my inbox.

zapreth answered Wednesday April 13 2005, 5:07 pm:
Yes. They can fight it. It is actually the dog owner who is supposed to pay I think. That is if their dog was not on a leash or chain. However, I am not an expert. Your friends parents need a lawyer to look over the case.

therocketsummer answered Wednesday April 13 2005, 5:06 pm:
If anything your friend's neighbor should get sued. Your friend's family was away, what could they do about the dog? It's not their dog. If it was it would be a different situation, but since it was someone else's dog it's not their fault. The little girl's family should get sued because the little girl hopped you friend's fence, that's trespassing. So your friend did no wrong and I hope she doesn't get sued and the little girl's parents come to their senses.
