I`m a senior in high school. I`m turning 18 soon but my boyfriend will still be 17. If we have sex after my birthday, will that be illegal?

There aren't to my knowledge any hard and fast rules about how big the age difference has to be to prosecute, but it would have to be a significant gap to be able to argue that the relationshipw as abusive and the younger person wasn't able to give consent. confusedbabii answered Saturday November 20 2004, 10:53 pm: no, it will not be illegal. it is only illegal if you are over the age of 18 and the other person is under the age of 16. as long as the other person is 16 or older it is legal. hope i helped!

AdviceKitty answered Saturday November 20 2004, 10:38 am: In some places it depends.But am aware that when someone turns 18 that person is considered as an adult and gets some rights,Like drinking ,etc(and depends too of the place)Take this advice of a friend,wait,wait until both are old enough and mature enough(not saying that ur immature,I mean it in the way that when u finish highschool,have a job,are idependent and dont depend on u family).
Take it slow,don't throw ur life away,sex can bring many consequences if not ready,pregnancy and std's.Think about it,and please,if u r desperate of having sex with ur boyfriend and cant wait that long,then atleast use protection,and it would be even better if u atleast wait till his 18.Hope it helps a tiny bitsy bit.Good Luck. Exceptions are too frequent to be able to draw conclusions without knowing what state you live in. You can find your state's age of consent with a quick Google search. Statutory rape laws are not frequently enforced in situations like yours, but there are plenty of circumstances (usually involving parents) in which teenagers have ended up on a sex offender list for having sex in situations exactly like yours. Being labeled as a sex offender for the rest of your life, which seriously hampers your ability to get many jobs, is not something to be taken lightly. QBillion answered Saturday November 20 2004, 1:50 am: Depending on what state you live in. Some states let you have sex at age 16, but most states' limit is 18. So if you live in one of those states, then even if your boyfriend's birthday was 1 day off and he was still 17 and you 18, it would be illegal, and technically rape, but you won't go to jail unless he or his parents report you and they have evidents that you slept with him, and if they pressed charges.
