You can be with him and it wouldnt be considered illegal but if you have sex with him he can get charged with rape. So if you plan on going any farther then sex i would wait on it.

Since the legal age of consent is 16, then no you two are not illegal.
If you were under 16 and he was over 16 then yes, you would be illegal.
Take me for example:
My boyfriend is 21 and I am 14.
Since I'm under 16 and he is way over 18, we are illegal.
Although it is not illegal as long as you don't have sex.
But just make sure you are comfortable with him and all, everything is okay.

I live in Michigan too- so I know the laws pretty well..
16 is still too young to have sex.. so waiting until you are 18 is the best thing you can do..
Just please make sure that this guy doesn't have any STDs before you have sex.. and always use protection (both a condom and birth control)
The reason I am cautioning you to make sure you practice safe sex is because I didn't and now I have HIV- and I don't want that to happen to you

If you live in the US.. it isn't illegal for 18 year olds to date 16 year olds.. unless you're having sex together.. because that would be considered Stagetory Rape.. and both of you could go to jail for that..
I suggest that if you want to have sex with him- then you should wait until you are at least 18.. because I'm not sure what the age is in each state when you are legally allowed to have sex..
