illegal .. ?

16 f. chicago, il
if i have sex with a 24 yr old male.. and im not unwilling either (i know. i'm horrible.)
what would the police do to him if neone found out?

Why would you say that? If you love this man, then having sex regardless of age shouldn't make you horrible.

Depending on your state, (i'm not sure of the law in Illinois) he may get charged with statatory rape. (Excuse my spelling, it's early and i'm not about to go spell check it.) As long as the two of you don't tell anyone that you are sexually actice, then you should be ok.

Well you ARE considered a minor but i believe that you should just "keep it quiet" between you and your special one at least until your old enough... Then who cares. When you're old enough to do it nobody can stop you. But you should first find out if this man really loves you because usually guys that much older are just looking for a girl that will give it to them and then they will leave when they have had enough... So make sure he isn't one of those guys. Hope this helped.

I would be a lot more scared of your father getting a hold of him before the "Po Po" come knocking if it happens. Everyone researched the statute for you. Obviously it's illegal...if you're found out, he goes to the bookings. (Jail)

The age of consent in Illinois is 17. As such, what would the police do? Quite possibly, hit him up with statuatory rape charges. Though what you say is humorous - if 'no one finds out' then there isn't any problem, how would the police know? Plus, if you both deny it, unless you had a camera or witnesses, how would they prove it? IMO this is stupid on his part; many women in your position have enjoyed the relationship until there is a fight, then they trot off to the police and file charges later on as a form of revenge.

I'd stop the sex, no matter what, unless you want him to take the chance of being tried/convicted and run the risk of being labelled as a 'sexual predator'.

TBH, though, usually it takes someone (a parent for example) to press charges - but thats hardly a hard and fast rule.

For everyone else, dont assume that its one age across the board in the USA, IT ISN'T. It differs from state to state, and some states even have some strange ins and outs. Want an example? [Link](Mouse over link to see full location) Read it, thats a great example. Every state has legal language that covers many situations, and each state is different.

For you, what would be applicable? Under Illinois law Sec. 12-16. Aggravated Criminal Sexual Abuse:

(d) The accused commits aggravated criminal sexual abuse if he or she commits an act of sexual penetration or sexual conduct with a victim who was at least 13 years of age but under 17 years of age and the accused was at least 5 years older than the victim.

As such:

(g) Sentence. Aggravated criminal sexual abuse is a Class 2 felony. (Source: P.A. 89-586, eff. 7-31-96; 90-735, eff. 8-11-98.) (720 ILCS 5/12-16.2)

If you want to keep seeing him/sleeping with him, thats the risk. If you have any feelings for him at all, I'd abstain from sex until you hit 17 (less than a year to wait, of course). Unless you want him to run the risk of a felony /shrug. This is just what the law is for Illinois as far as I was able to ascertain, the rest is up to you.

EDIT: and as far as I can tell, this is regardless whether or not the sex is consensual. You have to read the law for specific states. For Illinois, it looks like it doesnt matter if both parties are consenting, as YOU ARE A MINOR who is older than 13 but under 17.

Ok, well the first girl that answered is completely wrong. They put a legal age on things like that for a reason, because if every teenager wound up in court with an older man and they were the only ones that had say, things would be messed up because rapists would get away. So the legal age is pretty much 18 across the board, and if someone were to find out about you and him having sex he would be arrested and charged with statutory rape, whether you said yes or not. In the end it all comes down to, your underage and seen as not being able to make a life changing descicion like that for yourself, so thats why they make the legal age 18, so that way your an adult, and completely and souly responsible for yourself and your actions...hope I helped!!

Well, 16 is the age of consent in most states.
If you were to have sex with him you are at the age where its technically legal.
If the police found out the only way they would be able to do anything was if your parents were to take him to court.
& Even if they did that, you are able to have a voice in court, and you could verify that it was consentual.
Therefor: nothing would happen, lol.
