Question Posted Saturday November 12 2005, 12:02 pm
My dad has blood cancer and has been in the hospital for the past 6 months. His whole family is basically just waiting for him to die so they can get his money. None of them have even visited him in the hospital in the whole 6 months. Actually, his brother did--on his birthday. It's my mom's family that has been there for us and my dad. They don't want anything from my dad.
Everyone has been telling my mom to not even give them the chance at my dad's money if, god forbid, anything should happen to him. But we don't know if there is any legal way we can keep them from getting anything. Does anyone have any knowledge of this or any ideas?
I kinda know what to do, my mom worked for lawyers!
But, anyways, if your dad has a will written.
Go and talk to his lawyer about it.
He will tell you, what belongs to who.
&& what people will get.
You can also try talking to your dad about it and see if he remembers any of it.
Just ask him if he has ever written a will before.
Or ask your mom about it!
If you need anymore information or anymore help.
Just leave a message in my inbox.
Good luck hun!
And your family and dad are in my prayers!

LoveNJstyle answered Saturday November 12 2005, 2:18 pm: that's terrible but unfortunatly pretty common. you could get your dad to change his will to not give the others as much. make sure he doesnt procrastinate tho... thats basically all you can do. <3 [ LoveNJstyle's advice column | Ask LoveNJstyle A Question ]
DeadMemories answered Saturday November 12 2005, 12:55 pm: OMG! That sounds like my grandma. When she was about to die they all wanted the money. They didnt care. I have to greedy uncles. And when she did die we had to split EVERYTHING! What you need to do is tell them that they aint gettin no money and have your dad to make out a contract to what he wants you guys to have!
Jessica13 answered Saturday November 12 2005, 12:49 pm: you need to get a will for him to sign and that means if he signs the will for you and your mom to get everythiong then you will
k I hope the best for you
tell your dad what you think or know what his family is up to
ankeagle14 answered Saturday November 12 2005, 12:22 pm: Well, from what i know, no one has the right to the money except you and your mother, unless she is devorced or your father leaves behind a will saying that the mony goes to so and so. if she is divorced...she may or may not get it..im not sure, it matters where you live. get a lawer, or if you already have one, ask them. if you want me to anser it more, let me know.

CDefense15 answered Saturday November 12 2005, 12:15 pm: Do you have a will for him? If you do:
When a person dies and leaves a Will, the executor named in the will must apply to Supreme Court for a grant of probate. A grant of probate is a decision by the Probate Division of the Supreme Court that the Will is properly made and was intended by the testator to be their last Will and Testament. The application is made on a standard form ("Common Form"), and this is available from the Probate Division of the Supreme Court.
