Procuring Charge

Question Posted Thursday August 27 2009, 12:58 pm

Long story short
The boyfriend and i are sitting in our apartment hosting a small birthday party, about 6 people, drinking a pony keg being fairly quiet and just hanging out.
My room mates boyfriend (whom also lives there) decides he is going to invite 15 people over. They are very loud and obnoxiuos, i go out and tell them to shut the hell up. All of the sudden they all run to the parking lot get in a fight. Cops are called, everyone runs into the apartment. We are all minors so we lock the door and get down to be quiet. The police say "were going to bust down the door" (they can not) but this scares some dumb ass kid into hopping out the window. ALl the police jump in the window we get on the ground. They confiscate my marijuana, pipes and all that. But inorder to do this they had to dig through my closet. They were there for people, not bongs. They broke my closet doors, my bed supports, my organ. Turned the AC down to 55 witht the window wide open for my cats to jump out and a robber to come in. My roommates and I were all arrested got procuring possession and parafonelia. My father is getting me an amazing attorney, but id like to know what exactly i am facing here. i turn 19 in two weeks.

The polices' actions are completely illegal! Without a warrant, or due cause, i.e they actually see marijuana from the OUTSIDE easily, without having to search for it. Your lawyer, if he really is good, should know this. You legally should not get in trouble for the weed.

The cops should be prosecuted. I hope you succeed in your case! Also, I hope that you took lots of pics after everything happened.

You never have to let cops in with out a warrant. No matter what they say. They are taught how to manipulate you and scare you into letting them in. Just say "just a moment", put away anything illegal, and come out CLOSING THE DOOR behind you. Don't answer questions, just ask "is there a problem officer? most likely you will just face a noise violation, with an accompanying fine. Keep the topic there, and be polite.

(Our campus lawyer actually gave a lecture in one of my classes about this. We've had some police brutality issues in my town lately)

More than likely you will face possession of marijuana and you could get possible probation depending on if anyone pressed charges this also could go on your record. It all depends on the court and the judge as you are now over the age of 18 and the consequences could be harsh. Again, All depends on the court and the judge.
