illegal sex

Question Posted Sunday September 23 2007, 7:50 pm

okay so i'm 15/f and i live in new jersey. My bf who i've had sex with once so far is 20. I don't want to hear about how i shouldn't be dating someone older then me b/c i love him, and yes i do know what love means. My question is he doesn't what to have sex any more cuz he thinks its illegal. What if i give consent, doesn't that make it fine? and if it is illegal, what is the punishment?

it is illegal, no matter if you want to. it's because he is an adult and you are still classified as a child with the law. even if you don't press charges, if your parents find out, they can because they are still your guardians. and chances are, most parents would press charges. your boyfriend is right. it would be fine if you gave consent and were 18 at least, but since you aren't 18, he could be sent to jail. if anybody presses charges, that is. because even though you both were cool with it, that is statutory rape. and he would probably be classified as a sex offender. so you can see where he wouldn't want a criminal record here.

You don't have to report it yourself, your parents can report it. His parents can report it. Since you are below the age of consent, it is called statutory rape, as YG said.

According to a website (link provided below) "Sexual assault is sexual penetration with a victim between age 13 and 16 when the actor is at least four years older."
Statutory rape IS sexual assault. Even if you don't think so, the law says it is.
It is punishable by 5-10 years in prison.

Wise choice? If you care about your boyfriend's well being, you need to do your job to protect him. Meaning, don't have sex with him until you are 16- the legal age of consent.

its still illegal, even if you give him consent. as long as nobody finds out that youre having sex and youre both fine with it.. you should probably be fine. but if you wanna be on the safe side.. wait until you turn 16.

i live in new jersey and its not really okay, but it doesnt become a problem until you report it, like if he raped you or something, but as long as you and him both wanna do it, then by all means.

hope i helped?

Age of consent in New Jersey is 16. That means until you turn 16 the state of New Jersey considers you a minor (underage) and him an adult.

If it is found you are having sex with him (especially by a parent), he can be charged with statutory rape. Makes no difference if you consent or not, New Jersey says you are to young to consent.

He can go to jail. I don't know for how long. :)
