I'm 13/f. But my boyfriend was 16.
1. My step father had started sayig saying That if me and him had sex then that would be statitory rape, consensual or not.
Is it possible for him to get into trouble for having sex with me?
2. My parents put a restraing order against him. Once I'm not a minor anymore is it possible for that restraining order to count like would he get in trouble for being with me again?
Melody answered Sunday December 10 2006, 2:05 pm: Depending on where you live, your boyfriend can't get in trouble with the law. If he's under the age of eighteen, your parents can't really hold him up for statitory rape. Don't take my word for it, but i'm pretty sure i'm right.
- The only person he can get in trouble with is your dad probably.

So even if the person under this age agrees to sex it can still be classed as statutary rape. This means that, yes, he can get into quite serious trouble, particularly if your parents have already taken steps like a restraining order.
The law decided that anyone under the age of consent is too young to make that decision themselves, so the law steps in to make it for them. Variations on this ruling will apply where ever you are. If you are in the US the age may change from state to state.
The restraining order prohibits him from contacting you or coming within a specified distance. If he breaks this, he could be arrested.
Once you are no longer a minor, sex would not be classed as rape as long as you have agreed, (at any point you should change your mind and he does not stop, it would be deemed as rape).
The restraining order may have its own clauses that you would need to check.
