divorce papers

If you want a divorce but your spoude refuses to sign the pepers, are you still married until they sign them? Or can they be forced to sign them? Or do they even need to, to be fully divorced? Thanks all! I rate!

Until the divorce decree has been issued, you are still legally married. There's no way to force someone to sign the papers. However, in cases such as this, you can petition the court for a divorce. I would suggest speaking to a marriage attorney for more specialized advice. They can better explain the process and what you need to do. If money is an issue, look for an attorney that offers free consultations or look up your local legal aid. Good luck.

I highly suggest you hire a lawyer if your husband is being this difficult. Even if he is not being corporative, with some legal help you can still get a divorce.

if they wont sign it, you'll be still married. if it was THEIR fault, like they cheated on you, you can automatically get a divorce. You can also go to court, and explain your situation.

Hi there,

I am not sure whether you are in the US or uk, but over here in the UK you can file for divorce without the other person signing papers.

It is a much longer process but if the person asking for the divorce (petitioner) cannot get their spouse (respondant) to sign the documents then they can instruct their lawyer to go ahead anyway.

As I mentioned before it IS a much longer process (takes approx 3 years here!) but at the end of the day they will get their divorce!

Your best bet though would be to seek legal advice from a professional to get the eact answer because things are different in each case. For example - if it was a violent relationship things usually move quicker, or if their are children or property involved it can take longer to settle.

..Um, well... that's kind of something you might want to talk to a lawyer about. I don't suppose you'd expect a bunch of awkward teenagers speckled with some random adults here and there to really be able to help you. I'm sure you can't hold them down and force them to sign it. Still, there's likely a way to get out of a marriage without someone's consent, because like you can't force them to sign a paper, they can't force you to be married. Still, I wouldn't really know for sure.

Go to the court and explain that your spouse refuses to sign the papers and they are obligated to sign the papers or they can serve terms in jail
