Okay so if you've answered any of my previous questions its a yes I decided to ask and actually talk to him but I'm wondering if I should ask him on his birthday?

I'd wait some other day besides his birthday.
I mean lots of people are usually doing something on their birthday and possibly could be with their friends and such so if he says no, you don't want him to go straight to his friends or have them overhear or something.
So maybe the day after or some other day.
