18 and 15 dating legal if both parents know and approve?

Okaaay , so i am 15 years oldd. I live in Floridaa . I have been with my Boyfriendd for a year & i cant figure out the Law for thiss. If you are Dating & both parents knoe & agree is it still consdered Illegall ?!

It is illegal for a 15 year old and 18 year old to have sex in Florida.
The law doesn't care if your parents approve.

The age of consent in Florida is 18.

The "close in age exemption" means that someone 23 years old or younger can have sex with a 17 or 16 year old without it being criminal.

That means that until you turn 16, sexual contact between you and your boyfriend could end up with him charged with a felony in the second degree.

Now, if your parents are okay with you dating, then it's unlikely that anyone else would bother to report it if you did have a sexual relationship (dating isn't criminal, sexual contact is), nevertheless, you should not have sex with this guy until you are sixteen - if one of your parents changed their minds, as parents sometimes do - they could ruin his life forever, if he has sex with you underage.

Parental consent and the law are two different things. Parental consent may mediagate but will not overrule any laws in effect. The predominate factors are you are a minor and he is an adult in the eyes of the law.


Now some states, you will have to check Florida, do allow for a 3 to 4 year age difference between ages before the statutory rape charge can be used against the 18 year old.


If Florida has such a law then you are safe. If not and someone reports him to the police it is possible that charges of statutory rape, child molestation and other sex offenses could be made against the 18 year old. The fact that the 15 year old parents are approving could go either way. It could mitigate the charges or they too could face charges.


The law is the law but it is also interpretive. In this case knowing the law is important. The most important factor to know is if Florida allows for a 3 year difference in age between a minor and an adult.

Both parents approving doesn't change the fact you're still a minor, so it's still considered illegal until you're of age.

It's still considered illegal being your under the age of 18, while he is 18. It can be considered pedophilia and rape.

Having the parents agreeing just means you can't press charges against him later on if you decide to break up and things end badly.

My suggestion is to cut all sexual affairs with him til the time being, it is wrong to do so. At the age your at and the age he is at..it does not look right.

If you are talking by law, Of course it's illegal. In many cases it would be considered statutory rape if anyone 18 or older had sex with a minor.


If the parents approve that only means you are safe from them pressing any charges but really doesn't mean you are approved in the eye of the law.
