Question Posted Saturday December 18 2010, 1:14 am
I need advice on what to do in my situation. One of my school loans automatically took my payment directly out of my account without me authorizing it causing my rent check to bounce. My landlord wants the money in cash by monday but i will not have it available to me until thursday. I have no one i can borrow from. I dont know what to do. Will i get evicted if i cant pay it until thursday? Help!

Most landlords would prefer to be reasonable and give you a little leeway than to have to go through all the fuss of applying to the board to get a notice to send you an order to pay or move. It's a lot of hassle for them, and then they'd just have to find a new tenant. So keeping you is preferable. Just make sure you don't miss a payment again! From this point on you're going to have this same problem as it sounds like these are Federal student loans that have gone unpaid. The government doesn't fool around and they will garnish your wages on a monthly basis from now on. Very few states prohibit wage garnishment, but the Federal government has the right to garnish wages in all states for non payment of income tax, back child support and for non payment of student loans. Once student loans have gone to the point of wage garnishment there is nothing you can do except quit a job and work off the books. It stinks, I know, because you've probably just spent thousands up thousands of dollars getting an education. I'll leave the rent issue to the previous advicenator, but I just thought I'd let you know about the loans. Good luck! [ marinemom24's advice column | Ask marinemom24 A Question ]

I understand EXACTLY what you are going through, as I have been there myself, more than once.
The first thing to do in to explain as calmly as possible what is going on. If your landlord will not work with you, offer to pay a late fee on the rent. It will stink right now because that is more money out of pocket at the moment, but it will be cheaper than moving on zero notice.
If he refuses the late fee, then, from my experience, there is another reason that they want you out. Whenever a landlord refuses extra money, you better believe there is a reason. The odds are they were just waiting for a reason to try and get you out.
That only applies in the case of the refusing to even entertain the thought of a late fee.
As for being evicted... well, it completely depends on where you live. Each state has their own version of renter's rights. Some states require 30 days notice for eviction and some states only require 3 days.
Your landlord knows these laws. They are also counting on the fact that you do NOT know them.
I am not a lawyer, but if you ask me another question, and you tell me what city, county and state you live in, I will do a little research and see if I can find a legal aid group or renter's rights group that takes care of people in your area.
Most of these groups don't charge you any money.
Also, when you ask me another question, please provide an e-mail so I have a better way to reach you since you haven't created an account here yet.

Give him or her a buzz on the phone, and explain what exactly happened and that you'll have the money by Thursday. And I'm almost positive that you won't get evicted, its only 3 days. I could be wrong, and your landlord could be a complete a-hole Ha, but I'm sure that he or she will completely understand if you like i said, just give them a buzz and say Hey, something came up, and I need a 3 day extension. Try to be as polite as possible, and I'm sure that you'll be completely fine :]
