If you went to a drug store or something like that, asking if they have an application and if they are hiring is the same! Duh! They wouldn't give you an application if they weren't hiring. It just depends what kind of position they need.

Don't worry about asking if a place is hiring. Even if they're not, it's worth handing in an application, since they usually keep them on file in case they need to hire.
Best thing to do is ask them if they have any vacancies or if their hiring at the moment. If they are then you can ask them if you can get an application form to apply for the job. It would be pointless to ask for an application form when they may not even be hiring. :]
As for a place like a restaurant the best person to ask might be the person at the front (some have a person who seats everyone or checks reservations). If there isn't someone like this you may even find a member of staff wondering about in which case excuse yourself and then ask them if they know if the place is hiring. They'll probably say they'll check with their manager and ask you to wait after which they'll either bring you out an application form or the manager/supervisor may come out to talk to you him/herself. Ask the manager if they are hiring & if so, if he/she could give you an application. Then all you need to do is fill it out & hand it in.
