I bought a house back in Oct. 2004. When we were moving in, we noticed that there were still things from the previous owners. They said that they had a few things to take out of the house at closing. They also had said that there was a large pile of brush and other trash items in the back yard that were going to be picked up later that day. This did not happen. They are now telling us that they don't have to clean it up and that it is our responsibility. The problem is that in our area we have to pay for someone to come and pick up that stuff, or pay to drop it off at the landfill.
Whose responsibility is it? Thanks!

If there is nothing in writing and no agreement than you are stuck with the project, but I do know they have a clean up day usually in townships where people can bring the trash that they can't get rid of, you might want to call your local boro building and ask them if they have a clean up day and it will not cost you much at all. If there is nothing in writing saying that they were obligated to clean it up, then you are probably stuck with it. If you had refused to move in until it was done, that would have worked out better (but was probably impossible). I would say try to take him to small claims court, but by this time I would just take care of it myself.

Obviously theirs if they said they were going to clear it out in the first place, but it could possibly be yours since you bought the place before they took it. I suggest you consult a lawyer and see wether or not its worth taking it to court and if that doesnt work try a controlled fire to get rid of it? Good Luck!

It is their responsibilty. You need to have a meeting or a phone call with them and calmly tell them that you feel they should pay the money to have it picked up. Just don't use harsh words because these people seem ignorante (sp?) and willing to go to drastic measures over something like this. I hope I helped! ♥ good luck

I am not taking sides but it should be their responsibility to clean up when they move out. But since they are refusing to do it then your family should just pay for it and get it over with.

I definatly think its their responsibility..They left it there and then they said they would come back and clean it up..You could get into something legal about that..Let me know what happens! good luck
