Cartilidge piercing in gym!

Question Posted Thursday January 27 2005, 4:46 pm

I'm the one who asked if my gym teacher saw my cartilidge piercing what should i do, cuz I'm not allowed to have any piercings in, and your not allowed to cover them! So, I got caught today and I'm not allowed to take gym at all!! I'm going to the principal tomorrow, because I'm NOT taking my piercing out, i love it too much. They just now (this year) made the rule that we're not allowed to cover our piercings, and my gym teachers reasonings, is because kids as they get older get alot rougher. Which is a bunch of BS!! What is some stuff I can point out tomorrow w/ the principal. THANKS =)

It depends on how really smart you want to be and if you're too smart the principal might not like it. Of course it is different if you go to a public school or a private/secular school, however, most of the rules apply to both.

1. The school has to have written officially that you are not allowed to wear jewelry. It is not against the law to wear jewelry. (so if your principal says that we have no rule written that you need to go to the toilet to defecate either, you can say that there are laws that say you can't do it public either). I went to a private school and all the students are given a handbook of conduct and rules. You should ask for your school and where it says specifically you're not allowed to wear earings.

2. Also, if your principal was an old hippie he may be impressed by this (also it shows you did some research on it). Sorry, but I love making principals feel intellectually inferior sometimes.

In the case of Tinker v. Des Moines Independent Community School District of 1969- the Supreme Court ruled that high school students were able to wear black armbands to express their protest of the Vietnam War. This is the one case that has been used as a reference for any school restricting the right of expression of any high school student- which would be a violation of the 1st amendment of the constitution. (why do i know about this case? I took constitutional law in college?).

3. Also if there is a rule written, say that when was there public discussion on this issue with the school board (private schools have a board of trustees). Say that it isn't fair that there was not any discussion on this new rule if it is one.

4. Also, you may want to say that is there any evidence that injuries can be sustained b/c of such piercings? Have them site where they have statistics for it. There aren't any that I have seen. If it is because when kids get older, they get rougher, that doesn't answer the questions of how not wearing that earing will prevent injury? Afraid it may get pulled out? Unlikely, and would have to be done on purpose and say that you're willing to take the chance and will write (or your mom or legal guardian) will write that they will not hold the school responsible for injuries sustained (which you probalby had to sign to play sports anyway).

Hope that helps and always remember: DAMN THE MAN! SAVE THE EMPIRE! (if you've seen the movie "empire records" you'd understand that quote).

Good luck,
Arun

Tell them that it's not fair becuase you just paid like 30 somethin bucks to get it peirced, and your mother won't allow you to take it out. Then tell them that it's not fair to take you out of gym because you need to be in that class. Finally, if you really want to, get your mom to go up to the school board and BITCH them out. It usually works.. make her say something like "It's rediculous that my daughter can't be in gym just becuase of a peircing at the top of her ear, the one that I just spent all this money on.".. it SHOULD WORK. Good luck, I know how that is, it pisses me off, too.
