Can probation officers search a home without a warrant?

Question Posted Wednesday September 9 2009, 3:02 pm

Can probation officers break into your home and do a random search without a warrant when you're not there?

My boyfriend is on probation but I have a clean record. He has been going to classes, paying restitution, and working really hard. I've REALLY kept an eye on him and I KNOW he isn't doing bad things. He did miss one appointment with the Probation Officer and called right away to reschedule. I was really proud of him for taking responsiblity.

We were both at work the other day and they (the probation officers) came to our jobs and arrested us saying they searched our house and found something illegal. They claimed that they did not need a warrant to search our empty house. They never did tell me what they claimed to have found!

When they finally released me and I got home I found that they had broken in through the window (or so it looked like) and tore apart the whole house. I mean, it's a wreck...

Was this legal? I'm really confused

This is not legal, from the breaking in through a window, to not telling you what exactly you were arrested for. Talk to the police right away. The longer you wait, the less likely something will be done about it.

From what i know they too need a warrant because nobody can just come into someones house and destroy it completly like that i would contact the police and have them deal with this first and im not sure if they need a warrant but from the websites ive checked they cant but you should probably ask a police officer or contact a lawyer or someone with more sources and information.
