Is the Whack-a-kitten / Whack-A-Kitty video animal cruelty?

I have heard that there is a news story calling the famous "Whack-a-Kitten"(Actually "Whack-A-Kitty" but people seem to have taken over using the other title) video on YouTube animal cruelty!
Is this true? Have you seen it yet? Here is a link:
... the people apparently had made the box for the kittens to play in, since, as we all know, kittens do so love a box to play in, and then noticed that it looked like a whack-a-mole machine with them all frolicking about in there.
The idea was born out of sheer cuteness.
Even if someone made the case for cruelty here, I think intent would be required for any successful legal allegations, wouldn't it? If so, I don't think these folks show any intent to be cruel with the Whack-a-kitten / Whack-A-Kitty video. [ DangerNerd's advice column | Ask DangerNerd A Question ]

I think it's really cute too though.
It's obviously that the person is barely even touching the kittens. But people get really hyped up over animal cruelty. They'll consider a lot of things animal cruelty, even when it's blatantly obvious that the animals are not being hurt.
