Preliminary Hearing

Question Posted Saturday March 22 2008, 4:02 pm

First the crazy story in short.

I was at my Girlfriend's apartment around 4am when suddenly she jumped up, looked at me, and said that sounds like his car. Then came loud knockings at the door of her apartment, and by the knocks alone I felt threatened so I ran to grab my rifle. After I got it I ran into my girlfriend's room I placed a magazine into my gun. Right after he started slamming the other two doors into her apartment, and then came by her bedroom window yelling at my girlfriend to wake up. He start banging on the glass aswell, and after he didn't hear an answer he started to get very mad. He next started yelling things such as get out here punk. Everything he said was pretty stupid, but except for the last words which were you're dead! And then he headed back to the front door, and started kicking it at an attempt to break an entry point. After I herd a crack from part of the door's wooden frame splitting I pulled the action back on my gun, and stood ready to fire aiming at her bedroom door. Fortunately he gave up trying to break in, and then kicked in her living room window. After that he got into his car, and drove away. Her neighbors responded with a call to the police for us, and now this monday I have to appear in court for a preliminary hearing.

What will happen, and how should I be prepared to proceed in it?

dress nice, do what they tell you, and answer truthfully in a clear voice. shouldn't be all that hard, so don't get worked up about it.

A preliminary hearing is an evedencial hearing, it comes after a criminal complaint has been made by the prosecutor.

Just tell the truth, try to stay calm, I know it's a bit daunting but you're not the one at fault. They just want to know how serious everything was. The extent the criminal and civil cause of action will be heard. They need to find out what evidence will be admitted and what else must be done.

You will be fine. You did nothing wrong.
