My question is about Oklahoma Law.

I want to know if my 14 year old friend can talk to and visit with her 18 year old boyfriend, who just got out of jail and has not been convicted off any crime yet, but my 14 year old friends dad had my 18 year old friend arrested because they had been sexually active, then the dad dropped the charges and charges were picked up by the State, they are not 4 years apart in total age and we live in Oklahoma?

Oklahoma is pretty clear-cut - the 18 year old is toast more than likely.

I don't see them referring to is as 'statutory', but simply as rape.

If you 'friend' was UNDER 14 rather than being 14, it would be 'Rape in the 1st degree'[Link](Mouse over link to see full location)

As for sentencing guidelines: "Rape in the second degree a felony punishable by imprisonment in the State Penitentiary not less than one (1) year nor more than fifteen (15) years." [Link](Mouse over link to see full location)

Mike CFT is correct, it doesn't matter that the father dropped the charges, if officials get wind of it they'll press it themselves. Pray he gets as little as 1 year, and not the 15 year max. I doubt it will be 15, if it was consensual and she is willing to stand up for him, but thats no guarantee.

That's why its called Statutory- doesn't matter if someone presses charges or not; it's automatic. The best thing you can do is look it up in the OK state penal code or call one of your local police precincts as there are no lawyers or police officers from OK on here that I know of. Depends on the laws of your state; in one state this may be statutory rape, in others it could be something like sexual misconduct. Look it up and be on the safe side and don't base your answers on people who have watched a few episodes of Law & Order.

Dear Oklahoma,

I wouldn't recomend her talking to him at the moment, i would let things cool down for a couple weeks, it may be hard but it'll be worth it in the end.

He's eighteen, which makes him a legal adult.

She's fourteen, which makes her a minor.

Sexual, or non-sexual - it's statutory rape.
