Ok, so i know there was a ban on ephedra, but i also hear the ban was lifted. Was it really lifted? What stores can products with epedra in it be purchased? Thanks.

Erronius answered Thursday November 2 2006, 4:07 am: The ban is in limbo atm, as far as I know. Back in 2005 a company went to court over this, and won. They didn't win because the belief was that Ephedra was safe, rather it turned into more of a legal and procedural argument. Congress had set guidelines for the FDA to use, and the FDA didn't exactly follow those guidelines. Dietary supplements were meant to be more losely related to, and handled like, foodstuff rather than being treated like drugs themselves. The FDA had banned Ephedra, and the court ruled that they had indeed wrongly regulated Ephedra as a drug, and not a food. Part of the fallout of the ruling I believe was that the FDA was to re-evaluate what constitutes a 'safe' dosage, etc (though I couldn't tell you what progress there is on that front, I imagine the FDA will drag their feet as long as possible until forced). Also, the company that sued was allowed to resume production of a certain line of supplements, but it had to be under a certain dosage and a certain type of synthetic alkaloids I believe - they weren't just set free to sell Ephedra wholesale, all willy-nilly however they saw fit. And this didn't overturn the ban either as far as I know, though I would imagine that eventually some politician will force this back into the spotlight before too much longer.
I missed that back on Agust 17th of this year, the appeal for the above case was heard, and was reversed and remanded. The Court of Appeals basically found that the prior courts decision, in favor of Nuetraceutical, had been in error so to speak, and the Appeals court sided with the FDA ban. If you open the PDF file, you can see on the last page where it is mentioned that it finds that no dosage of Ephedra is safe (thereby shooting down the idea that small doses were ok).
If you are still looking to find any Ephedra, I am tempted to say not to bother. From what I've seen, most supplement suppliers are already moving to alternatives to Ephedra. And, as far as I can tell, the 'ban' is still in force, so to speak. I'd suggest looking at some of those alternatives ([Link](Mouse over link to see full location)), though I cannot tell you how effective they are as I haven't used any supplements for a few years now. Ephedrine was the less potent substitute in recent years since Ephedra was banned. You will need to be 18 to buy it in a health food store such as the Vitamin Shoppe or GNC when it comes back to the market, but I'll recommend now that you save your money.
