Suing Walmart

My fiance was recently terminated from his job, The distric manager came in and let him go.

I had bought a prepaid phone and he used his discount card which took off $21.00 a week later I returned the phone due to wanting to go under my fathers plan. I got back 178.00

Walmart stated he was not allowed to use his discount on me unless we were legally married. He was told he could use his discount as long as he was there and purchasing it as a gift. Basically walmart considered this to be loss of income and him using his discount to be stealing from the company.

He also was questioned for stealing, he accidently put a small toy ball in his pocket with intentions of returning it. He found this ball at work while he was on scedule. He had forgotten about the ball and ended up taking it home. He admitted to stealing as they had it on camera although it was really an honest mistake. He offered to even pay for the ball
We feel he was wrongfully terminated, I am the one who returned the phone and I paid for it and we wanted to know if this was a good enough to sue walmart. We are also thinking of suing for emotional stress

One problem, he had signed a paper admitted to stealing this object but this is not the case. Can we still fight this? We need help badly. Can we explain what really happened?..are we screwed...

Essentially screwed! Once you sign a paper admitting theft he has no case. NEVER sign a damn thing that means you admitted it. Unless a lawyer tells you to sign a document don't.

It doesn't matter at all legally or otherwise what your boyfriend intended. He should have never put said ball in his pockets for a second with recorders around. To Wal-Mart and the law this signifies intent to steal. He took it from the store so it's viewed as theft. You cannot sue as he was terminated properly.

As for the phone if it's returned and paid for that's it. Just be happy they haven't involved the police and theft charges. You have no grounds and he got off lightly here. Most prosecute no matter what was stolen.
