*Legal is age 18
*Below age 18, legal is 3 years down (so 17 for you in this case)
*The age of sexual consent is 16
If you take that all together, legally you're probably pushing it by being 16. It'll be better when you're 17, and most turn their heads.
The rule change from state to state. In general they're about all the same... I think Arkansas has a lower age of consent, Michigan has a higher one, I think... I'm not 100% sure, but in general, I'm going to rule this technically statatory...

If you're under the age of consent in your area and the two of you have sex, then he could end up arrested for statutory rape, even if it was completely consensual.
