Class 1 or Class 4 Misdemeanor Charges

18/f (who is a senior in high school)

I'm being charged with Lar-2337-m1

I was wondering why it's a class 1 charge and not a class 4 charge ?
(this was my first .. & will be last... offense..)
The item I stole was a 35$ shirt from a department store.

My other questions are:
Should I just plead guilty or no contest ?
& do I even need a lawyer if I'm going to plead guilty ?
& could I ever have this expunged from my record if I am found or if I plead guilty ?

Oh , and my friend also stole an item (we were together & got caught together)
(& yes we both very much regret it & will never do it again) but thats beside the point...

we were both banned from the store & had to fill out paperwork & they took our pictures.

She had to give her driver licenses to the man so he could look at it & she was told she'd be sent some paperwork & would probably have to pay for the item she stole. . .
We gave the items back, yet are going to still pay for them, we're banned from the store, & she was let go. . .
however, I do not have an id, my birth certificate and social security card do not match... my last names on them are different... & I have been trying to get that straight for 4 years. Any how, they told me if I would have had an id I would have been able to do the same as my friend... yet I'm being charged because I didn't have an id, which I tried to explain to the officer & security guy that I couldn't get an id and such because when I was born I had 2 fathers & things got complicated...
& so I went to jail... & am now dealing with these charges...
But I don't see how its fair that they let her go just because she had id... & I even had a school id I could have shown them but they would not take it. . .
Can some one help me figure out what I should plea? & im not trynig to complain because I know I did commit a crime & it was very wrong, & I regret it, but this is going to mess up my future completely & I realize that now that it's too late...

You are 18 which means these charges will be on your record for life if convicted at trial.

My best advice is to hire a lawyer. The fact that you and your friend where treated differently needs to be told in court. Unrepresented you will have trouble bringing this up in court, especially if pleading guilty or no contest.

If you cannot afford a lawyer the court will appoint one, but these lawyers are very overworked and not always the best of legal representations. If you can afford to hire a lawyer than it is in your best interest to do so s the outcome will effect you for the rest of your life.
