I know you probably won't like this answer, but this is the way to go if you want to avoid all the drama. Right now, since you're only in junior high, I think you should take a step back and not have anything more than a friendship with the kid whose brother likes you. It's not really right to come between brothers like that... because it's going to tear them apart even if they weren't very close to begin with.

He wont think anything of you. Well he will think something of you and its that your nice. I know it seems wierd and all but little brothers or little sisters and older sisters/brothers always compete. The 13 year old will think he is better then his brother and rub it in his brothers face that he's got a nice girl. I suggest you ask this guy out and tell his brother that you are sorry that you are just closer to the younger 1 and you feel more comfortable around him.
